§ 1 Scope
These terms apply to all orders via toonmoment.com between Viktor Ledin – Toonmoment, Von-Humboldt-Straße 11, 97688 Bad Kissingen (“we”) and you as customer.
§ 2 Service
We create personalised cartoon videos based on your photos and information using AI tools. Length, format and scope follow the product description. The look of the characters is based on the avatar preview you selected before ordering. The artistic execution (script, visuals, voices, music) is ours; the result is a drawn cartoon interpretation, not a photographically exact depiction.
§ 3 Contract and contract text
The website presentation is not a binding offer. By clicking “Order with obligation to pay” you submit a binding offer. The contract is concluded when payment is completed. You then receive an order confirmation by email with all contract details, these terms and the cancellation policy. We store the contract text; after ordering it is available to you via this email. Contract languages are German, English, Italian, Spanish, French and Russian.
§ 4 Photos, third-party rights and content
You confirm that you hold the rights to the uploaded photos and that all people shown have consented to their use for the video; for people under 16, their legal guardians. Not permitted: photos of people without consent, of celebrities, and content that is insulting, discriminatory, sexual, glorifies violence, degrading or infringes third-party rights. We may decline such orders and refund any payment. You indemnify us against third-party claims arising from a culpable breach of these assurances.
§ 5 Preview, corrections and defects
Before ordering you receive a free avatar preview (watermarked) and can regenerate it up to 3 times for free. The video itself is only created after payment. Until completion you can add information by replying to the order confirmation. After delivery, one round of small corrections (e.g. names, texts, details) is included if requested by email within 14 days. Otherwise the statutory rights for digital products apply (§§ 327 ff. BGB): we first remedy a defect free of charge.
§ 6 Prices, payment and codes
The prices shown at the time of ordering apply and are final prices; as a small business under § 19 UStG we do not charge VAT. Payment is made in advance via Stripe (card, Apple Pay, Google Pay, PayPal, Klarna etc.). One code can be redeemed per order (discount code or gift card); codes cannot be combined and cannot be paid out in cash. Discount codes are single-use.
§ 6a Gift cards
Gift cards are stored-value vouchers. They are offered for a specific video and are worth its price at the time of purchase; they can be redeemed for any video on toonmoment.com. If the chosen video costs more than the remaining value, you pay the difference; any unused amount remains on the gift card code. Gift cards are valid until the end of the third year after the year of purchase, transferable and cannot be paid out in cash. After payment you receive the gift card by email; on request we send it on a chosen date directly to the recipient's email address you provide – you are responsible for its correctness. During a payment in progress the value used is reserved for up to 75 minutes. We may block gift cards obtained by abuse.
§ 7 Start of performance and delivery
At your express request we start creating immediately after receiving payment and sending the order confirmation. The video is delivered as an MP4 download link to your email address, usually within 72 hours after payment. The link remains available for at least 30 days; please save the video.
§ 8 Rights of use
You receive a simple, unlimited right to use the video privately, give it as a gift and share it on social networks. For the company package the right covers internal communication and the company's own social channels; advertising use only by separate agreement. The AI-generated label must not be removed.
§ 9 Sharing as an example and thank-you
We only use your video as an example if you separately agree after delivery via the link in the delivery email. This is voluntary and has no effect on your order. It covers publication on toonmoment.com and our Instagram, TikTok, YouTube and Facebook channels, including as ads on these platforms. Everyone recognisable must agree and no one under 18 may be recognisable. After our review you receive, at your choice, a €10 refund to your original payment method or a €10 voucher. There is no right to publication. You can revoke your permission at any time without giving reasons with effect for the future; we will then remove the video from our channels without delay. You keep the thank-you.
§ 10 Right of withdrawal
Consumers have a right of withdrawal as set out in the cancellation policy. Because every video is made individually for you, at your express request we start immediately after payment. The right of withdrawal expires when creation begins (§ 356(5) BGB), provided you expressly agreed when ordering, acknowledged the loss of the right of withdrawal and we confirmed this in the order confirmation. Your rights in case of defects (§ 5) remain unaffected. When buying a gift card, the 14-day right of withdrawal applies without early expiry; if the gift card has already been fully or partly redeemed for a video, we refund the unredeemed amount.
§ 11 Liability
We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are only liable for breach of essential contractual obligations, limited to foreseeable, typical damage. Statutory warranty rights remain unaffected.
§ 12 Final provisions
German law applies excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection rules of your country of residence remain unaffected. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
